PastelPalace only sells online. There is no physical store at the above address.
Article 2 | Application
2.1 These general terms and conditions apply to all legal relationships in which PastelPalace acts as a supplier of products.
2.2 By using the PastelPalace website and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all rights and obligations as stated on the PastelPalace website.
2.3 General Terms and Conditions used by the Buyer do not apply.
2.4 PastelPalace reserves the right to change and/or add to the General Terms and Conditions.
Article 3 | Prices
3.1 All prices are expressed in euros.
3.2 PastelPalace cannot be held liable for deviations in prices, images and texts.
3.3 All prices are inclusive of Dutch sales tax and exclusive of other government levies and exclusive of shipping costs. The final shipping costs are calculated in the ordering process. PastelPalace is at all times entitled to make price changes.
Article 4 | Offers
All PastelPalace offers are without obligation. Offers are made subject to the availability of the products. If no longer available, PastelPalace has the right to deliver a similar product instead of the ordered product or to dissolve the agreement. Typesetting errors are reserved at all times.
Article 5 | Agreement
5.1 The purchase agreement between PastelPalace and the Buyer has been concluded at the moment that the trial period of 14 days after receipt of the order has expired.
5.2 The Buyer and PastelPalace expressly agree that by using electronic communication forms a valid agreement is concluded, in particular the lack of an ordinary signature does not affect the binding force of the offer and the acceptance thereof. The electronic files of PastelPalace apply, insofar as the law allows, as presumption of evidence.
5.3 PastelPalace has the right to cancel orders that have not been placed in accordance with the general terms and conditions.
Article 6 | Sales area
At the moment, goods are only delivered to customers within the EU.
Article 7 | Delivery and delivery time
7.1 PastelPalace strives after receipt of your payment to ship your order within 48 hours on working days (Mon to Fri, excluding holidays), unless stated otherwise during the ordering process.
7.2 The aforementioned delivery times are indicative and not definitive. PastelPalace is never liable for damage as a result of exceeding delivery times.
7.3 PastelPalace provides delivery by post or dispatch in any other way at the discretion of PastelPalace. Ownership of the products is transferred upon delivery if the products have been paid for.
7.4 PastelPalace is not responsible for damage and/or the loss of articles during shipment. If this occurs, please contact PastelPalace: info@Pastel-Palace.com.
7.5 The Buyer is responsible for entering the correct address details. PastelPalace is not liable for the consequences of incorrectly entered address data.
7.6 PastelPalace is authorized to make use of third parties in the implementation of an agreement with the Buyer.
Article 8 | Paying securely
8.1 Stripe: this is an online payment system developed by WooCommerce that can be used to pay throughout the EU. This is done via a secure SSL connection.
8.2 Paypal: with Paypal you can pay for your online purchases in a reliable, safe and easy way. Payments can be made from a bank account, credit card or from money received on the Paypal account.
8.3 iDEAL: An electronic payment via internet that can be compared to a PIN payment in a shop.
8.4 Bancontact (Belgium): With Bancontact you can pay for your online purchases in a reliable, safe and easy way.
8.5 SofortÜberweisung (Germany, Belgium, Austria and England): SofortÜberweisung is an online payment system aimed at five countries, namely Germany, Belgium, Switzerland, Austria and England.
Article 9 | Returning products
9.1 All enclosed warranty certificates, documentation and packaging material should, if possible, be enclosed with the product in the return shipment.
9.2 Products purchased via Pastel-Palace.com can be exchanged and/or returned without stating the reason within 14 working days after receipt at the delivery address. The Buyer can withdraw their order within fourteen working days after ordering, without payment of a fine and without stating the reason. The shipping costs are on account of the Buyer. To this end, you must contact firstname.lastname@example.org within 14 working days of receipt at the delivery address.
9.3 When you have received a defective product, PastelPalace will examine on a case-by-case basis whether there is a warranty and in case of warranty, which party is responsible for this. To this end, you must contact email@example.com within 14 working days of receipt at the delivery address.
9.4 If you have received another product instead of the ordered product, this will be exchanged by PastelPalace free of charge for the product you ordered, provided you still have the invoice, the purchase is in the original packaging and has not been used. The consumer is entitled to a refund of the order amount, provided it has already been paid. To this end, you must contact firstname.lastname@example.org within 14 working days of receipt at the delivery address.
9.5 When any product is returned under the above terms, the amount paid by you will be deposited into your bank account/Paypal within 14 days. You should always contact PastelPalace about this: email@example.com.
9.6 If the above deadlines are not respected by the Buyer, the rights of the Buyer stated above will expire due to the exceeding of those deadlines.
9.7 If you have returned products purchased through Pastel-Palace.com, please provide proof of shipment from the post office, so that it is possible to track the return shipment.
9.8 PastelPalace is never responsible for any damage, theft or loss that has arisen on return shipment to the packaging and/or the product.
Article 10 | Complaints, obligation to investigate and compliance
10.1 Complaints regarding the non-receipt of (part of an) order must be made within 14 days after receipt of the order confirmation, otherwise the correctness of the order is established.
10.2 Complaints regarding defects in the products must be made in writing and as soon as possible, but no later than 14 working days after receipt at the delivery address.
10.3 You have the obligation to check on delivery whether the products comply with the agreement. If this is not the case, you must notify PastelPalace of this in writing and with reasons as soon as possible and in any case within 14 days after delivery. If it has been demonstrated that the products do not comply with the agreement, you have the choice to have the products in question replaced by new products or to have the invoice value refunded.
Article 11 | Discount codes
In some cases or with specific promotions, discount codes are available. The use of a discount code is only approved/legitimate if it is used with the intended articles (this is stated with the articles). If a discount code is used incorrectly, the Buyer will be contacted to resolve this. The order will only be shipped when the correct total amount of the order has been paid.
Article 12 | Warranty
All items sold on Pastel-Palace.com are of good quality. If problems arise with the ordered products, please contact PastelPalace: info@Pastel-Palace.com.
No warranty will be applicable in the following cases:
– If wear can be considered normal.
– If changes have been made in or to the product, including repairs that have not been carried out with the permission of PastelPalace or the manufacturer.
– If the invoice cannot be submitted, has been changed or made illegible.
– If defects are the result of non-intended use or improper use.
– If damage is caused by intent, gross negligence or negligent maintenance.
Article 13 | Damage and compensation
13.1 PastelPalace can only be held liable for damage that can be attributed to its intent or gross negligence, or is caused by circumstances that are at its risk on the basis of mandatory legal rules.
13.2 Circumstances that are in any case not at the risk of PastelPalace are: illness, import, export and/or transit ban, transport problems, non-compliance with the obligations by suppliers, malfunctions in production, etc.
13.3 It is assessed on an individual basis whether compensation is applicable.
13.4 PastelPalace is not responsible for defects, damage, missing items and other problems arising during the shipping process where the order has not been received in the condition as sent by PastelPalace.
Article 14 | Applicable law / competent court
14.1 All legal relationships between PastelPalace and the Buyer are governed by Dutch law.
14.2 All disputes that may arise as a result of this agreement or of further agreements that may result from it, will be settled in accordance with the Regulations of the Netherlands Arbitration Institute or, if PastelPalace so chooses, the competent court of the residential or place of business of PastelPalace or the Buyer. The proceedings will be conducted in the Dutch language. The arbitral tribunal decides according to the rules of the law.
14.3 The applicability of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Article 15 | Dutch text prevails
The Dutch text of these general terms and conditions prevails over translations thereof.
Article 16 | Personal data
16.1 PastelPalace will include the information provided by the Buyer in a file. This data will be used for the execution of the order of the Buyer and kept for as long as necessary for the handling of any complaints as a result of the execution of the order.
16.2 Personal data will be treated confidentially and will not be passed on to third parties.
Article 17 | Rights
17.1 The Buyer explicitly acknowledges that all intellectual property rights of displayed information, communications or other expressions with regard to products and/or the website rest with PastelPalace, its suppliers or other entitled parties.
17.2 Intellectual property rights are understood to mean patent, copyright, trademark, drawing and design rights and/or other (intellectual property) rights, including patentable or non-patentable technical and/or commercial know-how, methods and concepts.
17.3 The Buyer is prohibited from making use of and/or making changes to the intellectual property rights as described in this article, such as reproduction without the express prior written permission of PastelPalace, its suppliers or other entitled parties, unless it is purely private use of the product itself.
